1. ACCEPTANCE OF TERMS

By accessing, using, or subscribing to Get BotEngine services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with any additional terms and policies referenced herein. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not agree to these terms, you must not access or use our services.

These Terms of Service constitute a legally binding agreement between you (the "Client," "you," or "your") and Get BotEngine (the "Company," "we," "us," or "our"). Your continued use of our services following any modifications to these terms constitutes acceptance of those changes.

2. SERVICE DESCRIPTION

Get BotEngine provides artificial intelligence-powered conversational bot solutions designed for business automation. Our services include, but are not limited to:

AI Conversation Bots: Intelligent chatbot solutions that engage with your customers through natural language processing, providing automated responses and facilitating customer interactions across various platforms.

Automated Booking Assistants: AI-driven systems that manage appointment scheduling, calendar integration, booking confirmations, and related administrative tasks without human intervention.

Lead Qualification Workflows: Automated systems that interact with potential customers, gather relevant information, assess lead quality based on predetermined criteria, and route qualified leads to appropriate sales channels.

Our services are provided on a subscription or project basis as specified in your service agreement. Service capabilities, features, and performance metrics may vary depending on the plan selected. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to active subscribers.

The AI-powered bots are designed to learn and improve over time. While we strive for accuracy and effectiveness, the performance of AI systems depends on various factors including implementation, training data quality, and ongoing optimization.

3. USER OBLIGATIONS

As a user of Get BotEngine services, you agree to:

Account Security: Maintain the confidentiality of your account credentials and accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

Lawful Use: Use our services only for lawful purposes and in accordance with these Terms of Service. You shall not use our services to transmit, distribute, or store material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

Accurate Information: Provide accurate, current, and complete information during registration and throughout your use of our services. You agree to update information promptly to maintain its accuracy.

Compliance with Laws: Ensure that your use of our services complies with all applicable local, state, national, and international laws and regulations, including but not limited to data protection laws, consumer protection laws, and industry-specific regulations.

Data Protection: Implement appropriate security measures for any customer data processed through our bots. You are responsible for obtaining necessary consents from your customers for data collection and processing activities.

Integration Responsibilities: Ensure that your systems, websites, and platforms meet the technical requirements necessary for proper integration with our services. You are responsible for maintaining compatible systems and resolving integration issues on your end.

Prohibited Activities: You shall not attempt to reverse engineer, decompile, or disassemble our software; interfere with or disrupt our services or servers; use our services to compete with us; or remove any proprietary notices from our materials.

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

For clients utilizing our Automated Booking Assistant services:

Booking Management: Our automated systems will manage appointment scheduling according to the parameters, availability rules, and business logic you configure. You are responsible for ensuring these configurations accurately reflect your actual availability and booking policies.

Calendar Accuracy: You must maintain accurate and current calendar integrations. We are not liable for scheduling conflicts or double bookings resulting from outdated calendar information or synchronization failures on your systems.

Cancellation Policies: You may implement your own cancellation and rescheduling policies through our system. Any cancellation fees, notice requirements, or rescheduling limitations are determined by you and enforced through our automation according to your specifications.

Service Modifications: If you need to modify booking assistant parameters, workflows, or availability rules, you may do so through your account dashboard. Changes typically take effect within the timeframe specified in your service documentation.

Client Notifications: Our system will send automated notifications to your customers regarding bookings, confirmations, reminders, and cancellations according to your configured preferences. You are responsible for ensuring these communications comply with applicable laws.

No-Show Policy: We provide tools to track and manage no-shows, but the enforcement of any no-show policies is your responsibility.

5. PAYMENT TERMS

Fees: You agree to pay all fees associated with your selected service plan as specified in your service agreement or on our pricing page at the time of purchase. All fees are quoted in United States dollars unless otherwise specified.

Billing Cycles: Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. Project-based services are billed according to the payment schedule outlined in your project agreement.

Payment Methods: We accept payment through credit cards, debit cards, and other payment methods as indicated during the checkout process. You authorize us to charge your designated payment method for all fees incurred.

Automatic Renewal: Subscription services automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your service plan.

Late Payment: If payment is not received by the due date, we reserve the right to suspend or terminate your access to services until payment is made. Late payments may incur additional fees as permitted by law.

Refund Policy: Fees paid for subscription services are generally non-refundable except as required by law or as expressly stated in your service agreement. Refund requests for project-based services will be evaluated on a case-by-case basis.

Price Changes: We reserve the right to modify our pricing with at least thirty days' notice to existing subscribers. Continued use of services after a price change constitutes acceptance of the new pricing.

Taxes: You are responsible for all applicable taxes, duties, and governmental assessments associated with your use of our services, except for taxes based on our net income.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

Damages Cap: Our total liability to you for any claims arising from or related to these Terms of Service or our services shall not exceed the total amount paid by you to Get BotEngine during the twelve months preceding the event giving rise to liability.

Excluded Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunities, or business interruption, regardless of the legal theory upon which such claim is based, even if we have been advised of the possibility of such damages.

Service Interruptions: We are not liable for any loss or damage resulting from service interruptions, delays, system failures, or unavailability of our services, whether caused by technical issues, maintenance, third-party service failures, or circumstances beyond our reasonable control.

Third-Party Integrations: We are not responsible for the performance, availability, or functionality of third-party services, platforms, or integrations used in connection with our services.

AI Performance: While we strive to provide accurate and effective AI-powered solutions, we make no guarantees regarding specific business outcomes, conversion rates, lead quality, or customer satisfaction resulting from use of our bots. AI behavior and responses may occasionally be unexpected or imperfect.

User Data: We are not liable for any loss, corruption, or unauthorized access to your data except to the extent directly caused by our gross negligence or willful misconduct. You are responsible for maintaining appropriate backups of your data.

Client Customer Interactions: We are not liable for the quality, accuracy, or consequences of interactions between your customers and our AI bots, except to the extent such issues result directly from demonstrable defects in our services.

7. WARRANTY DISCLAIMERS

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

General Disclaimer: To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

Service Availability: We do not warrant that our services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not warrant that our services will meet your specific requirements or expectations.

Accuracy of Information: We do not warrant the accuracy, completeness, or reliability of any content, information, or responses generated by our AI systems. AI-generated content should be reviewed and verified as appropriate for your use case.

Security: While we implement commercially reasonable security measures, we do not warrant that our services or your data will be secure from unauthorized access, cyberattacks, or other security breaches.

Results: We make no warranties regarding the business results, performance improvements, cost savings, or other outcomes you may achieve through use of our services.

Third-Party Services: We make no warranties regarding any third-party services, platforms, or integrations that may be used with our services.

Professional Advice: Our services do not constitute professional advice of any kind. You should consult with appropriate professionals regarding matters that affect your business.

8. GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws applicable to Get BotEngine operations, without regard to conflicts of law principles. Any disputes arising from or relating to these Terms of Service or our services shall first be addressed through good faith negotiations between the parties. You agree to waive any objection to venue in the applicable jurisdiction and consent to personal jurisdiction in such venue for the resolution of any disputes.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, or failures of third-party services or infrastructure.

Survival: Provisions of these Terms of Service that by their nature should survive termination shall survive, including but not limited to payment obligations, warranty disclaimers, limitation of liability, and governing law provisions.

Relationship: Nothing in these Terms of Service creates any agency, partnership, joint venture, or employment relationship between you and Get BotEngine.

By using Get BotEngine services, you acknowledge that you have read and understood these Terms of Service and agree to be
